Underage Drinking and Minor in Possession in Arizona

In the State of Arizona it is against the law for people under the age of 21 to consume alcohol. The legislature’s goal is obviously to reduce the consumption of alcohol by minors. The argument is that underage drinking leads to other disruptive behaviors such as disorderly conduct and vandalism.

Minors in Public Places

The laws in many other states prohibit minors from entering certain establishments. In Washington State for example, according to Seattle MIP lawyers a person under the age of 21 may not enter a bar whether or not they are accompanied by a parent.

In Arizona, on the other hand, minors may enter a bar as long as they are accompanied by a parent, legal guardian, or a spouse as long as the accompanying person is 21 or older.

Exceptions to MIP Law

There are two exceptions where minors may get away with consuming alcohol. First, in cases where the minor consumed liquor for a legitimate medical purpose and the health or safety of the public was not endangered. Second, in cases where the minor consumed liquor in conjunction with religious exercise or ceremony and the health or safety of the public was not endangered.

Minors and Fake Identifications

Minors attempting to acquire alcohol will face addition penalties.

Using a fake ID for purposes of obtaining alcohol from another person is a Class 1 misdemeanor. A minor can face up to six months of jail time and a fine of up to $2,500.

Even asking another person to purchase alcohol for you can land a minor in jail for up to 30 days and a fine of up to $500.

Using a fake ID in attempt to gain entrance to a place licensed to sell alcohol is a Class 1 misdemeanor and can result in up to six months in jail and a fine of up to $2,500.

Each law violation above can also result in a suspension of driving privileges for up to 180 days.
